MyValues Terms of Use

1. Introduction

The MyValues website is an online tool provided by Barwon Health that gives you the opportunity to identify your medical intervention values and provides a vehicle to share these values with friends, family and medical professionals as you choose.

You must read these Terms carefully before using MyValues. If you do not agree to be bound by these Terms, you must not use MyValues.

These Terms may be amended at any time. By continuing to use MyValues, you agree to be bound by any amendments or variations to the Terms.

2. Definitions

In these Terms the following words have the following meanings prescribed to them in relation to your use of the MyValues online tool:

2.1 Health Information has the meaning given to it in the Health Records Act 2001 (Vic);

2.2 MyValues means the online tool to state your wishes and values located at www.myvalues.org.au;

2.3 MyValues Profile means your profile on MyValues;

2.4 MyValues Report means the report generated from your wishes and values stated in your MyValues Profile reflecting your overall attitude to medical intervention;

2.5 Personal Information has the meaning given to it in the Privacy Act 1988 (Cth);

2.6 Terms means these terms of use;

2.7 you or your is a reference to the individual in whose name the MyValues Profile is held;

2.8 we, us or our is a reference to Barwon Health.

3. Access and Use

3.1 You can create a MyValues Profile by entering the Personal Information required under the “register now” tab on MyValues. After registering with MyValues, you will be provided with a MyValues Profile that becomes accessible by entering your email address and password.

3.2 Once you have created a MyValues Profile, you will be asked to complete the medical intervention statements that are then used to generate your MyValues Report.

3.3 You can provide a copy of your MyValues Report to individuals who you want to be aware of your wishes and values.

3.4 You may delete your MyValues Profile at any time.

3.5 We cannot guarantee that access to MyValues will be uninterrupted.

4. No Representations

To the extent permitted by law we make no representations and give no warranty of any kind, whether express or implied:

4.1 about the accuracy of your MyValues Report generated from your MyValues Profile; and

4.2 in respect of health services complying with the wishes and values set out in your MyValues Report.

5. Status of your MyValues Report and our Responsibilities

To the extent permitted by law we make no representations and give no warranty of any kind, whether express or implied:

5.1 Your MyValues Report is a record of your wishes and values only and is intended to be a persuasive influence on the provision of health services by medical professionals.

5.2 A MyValues Report is not legally binding. This means that even if medical professionals are provided with a copy of your MyValues Report, they are under no obligation to comply with its content.

5.3 We are under no obligation to confirm the accuracy of your MyValues Report or to distribute that report.

6. Your Responsibilities

By using MyValues you acknowledge and agree that:

6.1 you will only create and operate a MyValues Profile in your own name;

6.2 you will not attempt to access or operate a MyValues Profile that is not in your name;

6.3 all information you provide is true, accurate and correct;

6.4 it is your sole responsibility to:

6.4.1 ensure your MyValues Profile is continually updated to reflect your wishes and values;

6.4.2 maintain the confidentiality of any password you create for your MyValues Profile;

6.4.3 provide your most current MyValues Report to any individual, including medical professionals, that you wish to be aware of your wishes and values;

6.5 your wishes and values on your MyValues Profile are not legally binding on any health service provider and therefore may not be taken into account when providing health services to you;

6.6 MyValues is not intended to take the place of a professional medical opinion and any decisions regarding medical treatment should be made in collaboration with medical professionals;

6.7 upon deletion of your MyValues Account, it is your responsibility to inform individuals who are in possession of your MyValues Report that you no longer wish this document to be taken into account when making medical decisions about you;

6.8 you will not interfere with the proper working of MyValues; and

6.9 you will not cause, permit or compel another person to do any of the things which you agree not to do under this clause.

7. Consequences of Breaching these Terms

If you breach these Terms we may, without prior notice, suspend or cancel your MyValues Account or prohibit you from further use of MyValues.

8. Limitation of Liability

8.1 You acknowledge and agree that you use MyValues at your own risk and we are not liable for any loss or damage suffered by you in connection with your use of MyValues.

8.2 You agree to fully indemnify and hold us harmless against any expenses, costs, loss (including consequential loss) or damage that we may suffer or incur as a result of, or in connection with, your use of MyValues.

9. Viruses and Outages

We will use reasonable endeavours to ensure that MyValues and your MyValues Profile are not compromised. However, we cannot guarantee that no outage, interception, viruses, bugs, defects or spyware will affect MyValues or connecting devices.

10. Third Party Content

MyValues may contain advertising by third parties. Any third party links should be used at your own discretion. We do not sponsor or endorse any external website or advertiser. We are not responsible for the content or reliability of any linked website and cannot guarantee that these links will work or will not contain viruses.

11. Intellectual Property

11.1 All data, graphics, photographs, images and other content contained in or accessible via MyValues is owned by us or used under licence and is protected by Australian copyright laws.

11.2 MyValues contains trademarks, logos and trade names which may be registered or otherwise protected by law. You must not use any trademarks, logos or trade names which are used on MyValues unless we have consented in writing to this use.

11.3 By using MyValues, you acknowledge that we do not grant you any licence, right to or assignment of all or part of our intellectual property in MyValues.

12. Confidentiality

We will maintain the confidentiality of the information you enter into your MyValues Profile. However, by creating a MyValues Profile, you consent to us using your information, including the information contained in your MyValues Report, for the purposes of analysis and research provided that we appropriately de-identify the information.

13. Privacy

13.1 As is required by the Privacy Act 1988 (Cth) and the Health Records Act 2001 (Vic), we ensure the protection of any Personal Information and Health Information disclosed by you on MyValues.

13.2 By using MyValues you agree to the collection, use and disclosure of your Personal Information and Health Information in accordance with our privacy policy which can be found at www.myvalues.org.au.

14. Jurisdiction and Governing Law

14.1 These Terms are governed by and construed in accordance with the laws of Victoria, Australia.

14.2 Nothing in these Terms is intended to exclude, restrict or modify rights which you may have under any law.

14.3 If any provision of these Terms is invalid under any law, that provision is enforceable to the extent that it is not invalid, and if it is not possible to give that provision any effect at all, then it is to be severed from these Terms and the remainder of these Terms will continue to have full force and effect.
